Terms of Service — MathBuddi

1. Acceptance of Terms

By accessing or using MathBuddi ("the Service"), operated by MathBuddi ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. If you are creating an account on behalf of a minor, you represent that you are their parent or legal guardian and agree to these terms on their behalf.

2. Description of Service

MathBuddi is an adaptive K-12 math tutoring platform. The Service includes:

An adaptive diagnostic test that identifies a student's precise math level
Procedurally generated math questions tailored to the student's current ability
AI-powered progress reports and performance analysis for parents
Parent dashboard for managing child accounts and monitoring progress
Gamification features such as streaks and experience points to encourage consistent practice

3. Account Registration and Responsibilities

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

You must be at least 18 years old to create a parent account. If you are a student aged 18 or older, you may create your own student account. Students under 18 must have a parent or guardian create and manage their account.

4. Parent Accounts and Child Accounts

Parents or guardians ("Parent Users") may create and manage accounts for their children ("Child Accounts"). As a Parent User, you:

Consent to your child's use of the Service and the collection of their data as described in our Privacy Policy
Are responsible for managing your child's account settings, including report visibility and session configuration
May add up to 3 child accounts under a family subscription
May delete a child's account and all associated data at any time from the Settings page

5. Subscription and Billing

MathBuddi offers a subscription-based service. Key billing terms:

Free Trial: New accounts receive a 7-day free trial with full access to all features. No credit card is required to start the trial.
Automatic Renewal: Subscriptions automatically renew at the end of each billing period (monthly or annual) unless cancelled before the renewal date.
Cancellation: You may cancel your subscription at any time from the Billing page. Upon cancellation, you retain access until the end of your current billing period. No refunds are issued for partial billing periods.
Price Changes: We may change subscription prices with 30 days' notice. Price changes take effect at your next billing cycle.

Payments are processed securely through Stripe. We do not store your credit card information on our servers.

6. Intellectual Property

All content, features, and functionality of the Service — including but not limited to the question generation algorithms, diagnostic system, user interface, text, graphics, and software — are owned by MathBuddi and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

7. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of these terms
Attempt to reverse-engineer, decompile, or extract source code from the Service
Interfere with or disrupt the integrity or performance of the Service
Create accounts using automated methods or false information
Share your account credentials with third parties or allow others to access the Service through your account

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information and your child's data. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure. MathBuddi is a supplemental educational tool and is not a substitute for formal education or professional tutoring.

10. Limitation of Liability

To the maximum extent permitted by law, MathBuddi and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising under these terms shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service at any time for conduct that we believe violates these terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately. You may also delete your account at any time by contacting us. Sections regarding intellectual property, limitation of liability, and indemnification survive termination.

12. Governing Law

These terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles. Any disputes arising from these terms or the Service shall be resolved in the courts located in Ontario, Canada.

13. Changes to These Terms

We reserve the right to modify these terms at any time. If we make material changes, we will notify you by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the changes become effective constitutes acceptance of the revised terms.
